Soft Play Rental Agreement

This Rental Agreement is entered into between the renter (“Renter”) and Love 2 Party Rentals. By submitting payment for any rental services, the Renter acknowledges that they have read, understand, and agree to be bound by the following terms and conditions:

Liability & Risk

Waiver and Release:
The Renter hereby releases, waives, and forever discharges the Company, its owners, employees, affiliates, and representatives from any and all liability, claims, demands, or causes of action arising out of or related to any injury, illness, death, or property damage resulting from the use, operation, or possession of the Company’s equipment.

Indemnification:
The Renter agrees to indemnify, defend, and hold harmless the Company and its representatives from and against any and all claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or related to injuries or damages sustained by the Renter or any of their guests (including minors), whether or not caused in whole or in part by the Company’s negligence. In the event the Renter initiates legal action against the Company and does not prevail, the Renter agrees to reimburse the Company for all associated legal fees and costs.

Assumption of Risk:
The Renter acknowledges that the use of the Company’s equipment and participation in related activities involve inherent risks, including but not limited to injury, illness, death, or property damage. The Renter voluntarily assumes all such risks on behalf of themselves and their guests, whether known or unknown, and regardless of whether such risks arise from the negligence of the Company.

Warranties:
All equipment is provided on an “as is” basis. The Company makes no representations or warranties, whether express or implied, regarding the condition, safety, or performance of the equipment.

Limitation of Liability:
To the fullest extent permitted by applicable law, the Company’s total liability for any claim arising out of or related to this Agreement shall not exceed the total rental fees paid by the Renter.

Equipment Rules

Age & Supervision:
Equipment is intended for use by children ages five (5) and under only. Continuous supervision by a responsible adult aged eighteen (18) or older is required at all times.

Prohibited Items:
The following are strictly prohibited on or near the equipment:

  • Pets

  • Shoes or bare feet (socks must be worn at all times)

  • Food, beverages, gum, or candy

  • Sharp objects, jewelry, or eyeglasses

  • Messy or staining materials, including but not limited to face paint, slime, markers, glitter, silly string, or confetti

Equipment Care:

  • Rough or unsafe play is not permitted

  • Equipment and accessories may not be moved, altered, or dismantled

  • No barbecues, fire pits, heat sources, or smoking within fifty (50) feet of the equipment

  • Maximum occupancy limits, as stated in the product description, must not be exceeded

Renter Responsibilities

Guest Notification:
The Renter is solely responsible for ensuring that all guests are informed of and comply with these terms and rules.

No Subleasing or Lending:
The Renter shall not lend, transfer, or sublease any rented equipment to any third party.

Damage and Loss:
The Renter agrees to be financially responsible for the repair or replacement of any equipment that is lost, stolen, or damaged during the rental period.

Security Deposit:
Any required security deposit will be refunded within five (5) business days following equipment inspection, provided the equipment is returned in clean, dry, undamaged condition and has not been relocated. Additional charges may apply for damages exceeding the deposit amount.

Site Requirements:
The Renter shall provide a level setup area that is free of debris, glass, and pet waste. Equipment may not be installed on dirt or gravel surfaces.

Delivery and Pickup Coordination:
If the Renter is not present at the time of delivery or pickup, the Renter is responsible for coordinating with the event venue to ensure proper access, setup, and return of all equipment.

Ball Pit Return:
If a ball pit is included in the rental, all balls must be returned to the ball pit prior to pickup.

Photography Release:
The Renter grants Love 2 Party Rentals permission to use photographs taken at the event for marketing and promotional purposes.
